Ishrat Jahan an innocent girl sacrificed at the altar of the Hindutva Moloch

Preface The year 2013 saw two biographies of the Chief Minister of Narendra Modi. Neither does The NaMo Story: a political life by Kingshuk Nag nor does Narendra Modi: The Man, The Time by Nilanjan Mukhopadhya have anything to mention about this Lucy Gray of Mumbra suburb. And yet this little unknown girl may prove to be the Achilles heel of Modi. Even if the events finally may not turn the way anyone would have his wish fulfillment to see the denouement to take but Ishrat Jahan is one of the hundreds of daughters of mother India who come clean belying their baiters. That happening every week on such a scale does not reduce the individual position of the girl from Mumbra. There is overt danger that vertically divides the country. Shiv Sena views the cold blooded fake encounter of Ishrat Jahan as rape of National Congress Party president Sharad Pawar upon her. This was in the context of his preferring to travel to Mumbra, her suburb in Mumbai, in a local train hauling him upon the crowded train and sweating in the sultry May of 2013. Another cold blooded victim of Hindutva extremism is the death of Khalid Mujahid on May 18, 2013 at the hands of Hindutva tainted police. On May 26, 2013 Shiv Sena held a protest rally in Moradabad against the dropping of charges against him by the UP government. (See photo in Asian Age of May 27). This is a tragic irony that the Hindu parties choose to play politics of terrorism while their victims like Ishrat Jahan or Khalid Mujahid might have had no hateful attitude towards the majority community. Introduction

On May 10, 2013 the Gujarat High Court passed stricture against the state government for shielding the police men behind the kidnap and murder of Ishrat Jahan and three others Javed Shaikh alias Pranesh Pillai, two alleged Pakistani nationals Zeeshan Johar and Amjad Ali Rana o. This castigation came at a time when the Chief Minister of Gujarat was busy in manicuring and choreographing and appearing on screens of electronic media for his hype over moving to the central government as nothing less than the Prime Minister of India. The Division Bench comprising Justice Jayant Patel and Justice Abhilasha Kumari came down heavily upon the government for “shielding, protecting and siding with police officials” that had slandered her and three others and then murdered them in the name of patriotism. They showed their male macho chauvinism in having finished the poor girl and three. The Additional Director General of Police (ADGP) P.P. Pandey went underground for this girl of no consequence. In the dispensation of justice in the state of Gujarat after the pogroms of 2002 there is little doubts that there were many more rogue officers and many rogue government agencies played havoc with the minority community. But there was no one around to call either the chief executive of the state as rogue or the state as rogue. Therefore a rogue who runs a rogue state cannot be expected to be brought to book so easily because there is no silver bullet made to kill this Emperor Jones. The banana republic where Eugene O’Neill’s emperor ruled was awed by the belief that he could be killed with a silver bullet. The subjects of the emperor were so poor that they had no handful of food to eat let alone a silver bullet. Gujarat may be one of the richest states of India but it is still under the thralldom of such an emperor who does not brook opposition to his rule. If he cannot stand his own mentor LK Advani or his own Home Minister Haren Pandya what is the position of a Muslim girl! Chapter 1 The modus operandi of framing Muslims The serial bomb blasts in UP cities of Lucknow, Faizabad and Benares on November 23, 2007 killed 18 and injured 21. On December 12, 2007, a Unani doctor was returning from his dispensary at night when a Tata Sumo reached him some unknown people got down and took the doctor in the car and drove away. On December 14 the family members of the doctor file a complaint of the missing doctor in the village of Rani ki Sarai. The leaders of the community and some politicians organized a sit in at the headquarters of the district of Azamgarh and as usual sent a memorandum to the chief minister. The family members also tried to locate the doctor’s phone by putting his phone number on surveillance. In a similar operation a Sumo took away a teacher in a Madrassa in Barabanki. The family members complaint to the police and went out in search. They gave memorandum to the authorities about the missing teacher. They even faxed National Human Rights Council and the Director General of Police on December 16. On December 17 local papers splashed the news of the arrest of the teacher. The local people went to police station and met the authorities in connection with the arrest of the teacher. On the same day they also sent memorandum to the chief minister of UP and the District Magistrate of Jaunpur. In the night of December 18th some people came to the house of the teacher and took away some books from the house. As if the wary community in the village was apprehensive of mischief they again sent memorandum to the chief minister and the chairman of the National Human Rights Commission the second day,that is on December 19. On December 23 the police made a melodramatic announcement that they had caught two persons charged with the serial bomb blasts. Chapter 2 A disturbing pattern of Gujarat fake encounters is that when there is some definite lead to a case and the cops are arrested that leads to other crimes of the same nature committed further in the past. This is a sure sign of the malaise in the police investigation and the judicial process. Senior police officer and right hand man of Narendra Modi was DG Vanzara he was arrested for the murders of Sohrabuddin, his wife Kauser Bi and friend Tulsiram Prjapati in November 2005. The Gujarat police did not conduct investigation impartially so the High Court handed over the case to CBI on December 1, 2011. Two more years passed and then the Sohrabuddin case was transferred out side Gujarat to Mumbai High Court. On June 4, 2013 Vanzara was arrested and taken to Sabarmati jail, Ahmadabad, Gujarat, to face the fake encounter case of Ishrat and the others who were murdered a year and half before Sohrabuddin. This establishes the fact that the case of 2004 was not properly investigated and a similar set of crimes was eliberately perpetrated by the same group of cops of Modi. What is more, even the motive of the supposed terrorists was the same according to investigation agencies of Gujarat. This is strange since Modi’s “spy network of Shivaji” was so sharp that it was telling him every single move of Haren Pandya, his deposing before the people’s tribunal and his movement in the city. Even Pandya’s murder in March 2003 hearkens back to the September 2002 murder of Samir Khan Patha. Then further back it goes to the murder of Sadik Jamal Mahtar in January 2001. This network did not stop with the killing of Sohrauddin. How could all these and many more be killed and yet Modi remain in the dark. But case after case involving terror incidents and arrest of Muslims shows a pattern: that accused of terrorism charges Muslims educated youths are imprisoned but finally released as innocent of the crimes they were accused of. Why? Chapter 3

Gujarat as a rogue state and the man who made it so

In just over a year after Noam Chomsky published his Rogue States, the rule of force in world affairs (2000) the state of Gujarat in India began a widely feared and carefully thought Hindutva laboratory experiment. In plain terms it was designed to show the Muslims that they were at the sufferance of the Hindu majority and must learn to know their place and cease to be nuisance in their equation with the majority. The pogroms that followed and the subsequent fake encounters fall into this pattern. The Chief Minister of the state Narndra Modi and the Prime Minister of India AB Vajpayee and his deputy and Home Minister LK Advani maneuvered to let Modi continue his rule despite wide condemnation of the slaughter of more than two thousand Muslims, the inhuman boycott, the social and economic apartheid forcing them to live a dehumanized life in relief camps, disempowering them further and dispossessing them of whatever property they had in the holocaust that suddenly changed their life. Even a decade later their life has not returned to normal and there is no hope and scope left to them to improve their lot. The two convincing examples of Cuba blockade and Indonesia attack on East Timor compare and contrast with what Modi did with tacit approval and later open approval of Vajpayee and Advani. The blockade made the Cubans suffer inhuman conditions of poverty, disease and starvation. This was vehemently condemned by the UNO, the European Union, the Organization of American States, etc. the US did not relent. In the same way in the East Timor war of 1975 the US supported the Indonesian generals to the hilt. Within two months 60, 000 people were killed within years the number rose to 200,000 thanks to the support US gave to Indonesia. UN Ambassador Daniel Patrick Moyanihan was given the task to make UN ineffective. “The US wanted things to turn out as they did, and worked to bring this about. The Department of States desired that the United Nations prove utterly ineffective in whatever measures it undertook. This task was given to me, and I carried it forward with no inconsiderable success.” In the pogroms of Muslims in 2002 Modi government rejected the declaration of the collector of Godhra that the fire in the S6 compartment of the Sabarmati Express on February 27, 2002 was an accident and chose Intelligence Bureau joint director Rajendra Kumar’s insinuation that it was a conspiracy of the Inter Services Intelligence of Pakistan to sabotage India through terrorism. For three days the chief minister allowed the Hindus to take revenge upon the Muslims. The systematic planning to wreak havoc upon Muslims is well documented fact. The discrimination in paying relief, closing the relief camps, subverting judicial process through the RSS tainted public prosecutors, using the Advocate General Tushar Mehta to send information to S Gurumurthy how best to deprive Muslims legal aid and instead of defending them aid the perpetrators of the genocide, etc. Next came the fake encounters and the boycott. In the case of the fake encounters the Gujarat police in cohort with the police in Maharashtra, Andhra Pardesh, Rajasthan, and Jammu and Kashmir abducted Muslims and took them to Gujarat and kept them in illegal detention in private bungalows tortured them and killed them and dumped their bodies at roadside proclaiming them to be Muslim terrorists on mission to kill Modi, Advani and Tagodia. This in essence is the three extraordinary renditions. The Prime Minister, the Home Minister of India gave cover to Modi and issued clean chits and called him the best chief minister in India. So tightly was the whole operation conducted that even a decade later the perpetrators and the architect of the genocide are untouched except in some prominent cases. As this was going on in Gujarat India started its war on terrorism in the manner of the US. Bombs exploded for almost a decade intermittently all over the country in which Muslims were falsely implicated and Gujarat had its due share in this like the Modasa blasts of September 29, 2008. The intention in arresting most of the innocent Muslim victims of this war on terror is unquestionably doubtful. Himayat Baig accused and convicted to death in Poona German Bakery blast was and is innocent. If he had collected money it was through tuition he was taking. He was, moreover, in Aurangabad when the blast took place. Ishrat Jahan was in Mumbai when she was kidnapped and taken to Gujarat and killed. Sohrabuddin and his wife were kidnapped from Maharashtra and so was Sadiqu Jamal Mehtar. Tulsiram Prajapati was transferred from Rajasthan. Detailed report of Justice Nilesh in the case of Khalid Mujahid and Tahir Qasmi shows that the police had abducted them and later showed them arrested and much later framed them in bomb blasts. In the same way the intention behind Nutin Thakur filing a court case against the offer of 6 lakh rupees by the UP government to the family as compensation could be either a purely legalistic concern or a demonstration of majority communalism. Jawaharlal Nehru had rightly feared majority communalism as more dangerous. It could become the official view. As the senior cop in Dhulia in 2008 felt that all the masterminds are automatically Muslims and therefore those arrested in the communal riots of October 5, 2008 were also terrorists. That Hindus too were arrested but he did not bother to apply the term terrorists or masterminds to them. It is this intention that shows predilection of the police and investigation agencies. It is not that all the police and sleuths to the last man are biased. But they are controlled by the reports and instructions they get from the Intelligence Bureau in Delhi. A newspaper report according to the Nimesh Commission inquiring into the arrest of Khalid Mujahaid and Tahir Qasmi says that the IB had kept Khalid Mujahid under its surveillance for the last six months ending on his arrest on December 22, 2007. If this were so why did not IB prevent the serial blasts in Lucknow, Faizabad and Benares? Where is the corroborative evidence? If Ishrat Jahan was a terrorist why was not she caught alive and where is the blue car she was supposed to be traveling? The apologetic statement of Rajendra Kumar is an attempt to whittling down the false report he prepared and also fed the American agency, FBI. If Arun Jaitly thinks that the CBI is harassing Narendra Modi since he has moved to the centre stage as in charge of 2014 election and is the potential candidate of the post of prime minister what is there in his past still hidden from public knowledge? If Modi felt proud at the killing of Ishrat Jahan and considered it as another feather in his cap to flaunt, then, what about the series of such fake encounters which have added up so many feathers in his cap on top of the gruesome pogroms of Muslims in 2002? What is his intention in remaining unrepentant when the world knows so much of what really happened there? What is also the intention of the extremist Hindus to vote him to become the next PM? It is highly poisonous of Arun Jaitley to cast aspersion on the very few police officers who stood up to Modi and opposed his misrule especially related to 2002 genocide. They refused to genuflect before Modi. In contrast with them is PP Pandey and a host of others who towed Modi and his line of thinking of venting anger over the Muslims. Pandey is still absconding from law in the case of Ishrat Jahan. Should PP Pandey like PC Pandey be allowed to rule Gujarat as far as the law and order is concerned? Why the majority of the people in Gujarat still stomach such hogwash of people like Jaitley who says “Over the years, the political strategy of the Congress party in Gujarat is hardly guided by its state leadership. It has been guided by a few disgruntled police officials who have been accused of indiscipline by the state Government.” This is the rot in the whole system of Modi’s Gujarat. Will the people of India go according to what Jaitley says and allow PP Pandeys take the law in hand as Modi is supposedly leading in the poll casts and is going to be the PM? PC Pande, Mysorewalla, DG Vanzara and their likes were the henchmen of the kingpin in the encounter cases, Modi’s own lieutenant Amit Shah. Can the fate of India be safe in the hands of such demoralized men as Modi and Shah but not safe in the hands of such men of probity as RB Sreekumar, Sanjive Bhatt, Rahul Sharma whom Jaitley calls undisciplined. How can the Gujarat government be in the hands of the disgruntled officers when their boss was and still is no other than Modi, the Home Minister and also the chief executive head, Chief Minister? Jaitley was a lawyer. How could he dub the evidence against Amit Shah negligible? It was Shah who had ordered the arrest of Sohrabuddin. When Kauser Bi resisted the arrest he ordered her arrest too. She was raped and killed in the bungalow owned by the Jirawala brothers and Amit Shah. This cannot be “negligible evidence”. If BJP leaders like extremist Hindus continue to talk like this the case should be handed over to a foreign intelligence agency under the aegis of the UN. Because as long as Gujarat is under the control of BJP and Modi there is no chance of truth coming to surface. The mass atrocities suffered by Muslims really need investigation by the UNO through the optional protocols of the Security Council. India is a signatory to the covenant against genocide. The fake encounters were also a part and parcel of the genocide. The noting on the files of the police officers were seen and approved by the Home Minister who was Modi. Vanzara was transferred to border region which touches Rajasthan to facilitate the fake encounter of Tulsiram Prajapati. This was done with Modi’s approval and Modi had lot of stake in the case of Tulrsiram Prajapati. He was the sharp shooter who had killed Haren Pandya as far as the available testimonies go. When Sanjiv Bhatt expressed this he was immediately arrested, suspended and demonized. But no effort was made to ascertain and inquire whether what he had said was true? Rajendra Kumar was as much tainted with right wing ideology of hate when he and his pal Modi were in Chandigarh where Modi was in charge of the Punjab election. In the case of the genocide of 2002 RB Sreekumar says "Then DGP told me that Central IB joint director, Ahmedabad, Rajendra Kumar had come out with the theory of ISI conspiracy behind the Godhra incident and he had cajoled the DGP to pursue investigation, treating the Godhra incident as a conspiracy." Coming to make a full circle Kumar’s statement is worth vetting in the company of his apologetic statement to CBI that he had warned the Gujarat police but had not told them to kill her in a fake encounter. But the crucial point is why did they abduct her to Gujarat and then kill and at whose instance? But case after case involving terror incidents and arrest of Muslims shows a pattern: that accused of terrorism charges Muslims educated youths are imprisoned but finally released as innocent of the crimes they were accused of. Why? Or, what is even worse, they are killed in judicial custody. Khalid and Ishrat fit in the same mosaic pattern of hunting and framing Muslims. There is s slight flicker of light at the end of the tunnel that Ishrat Jahan murder will expose the Achilles heel of Modi. It came in the vetting of the documents regarding her by Arun Jaitley. It is quite likely that at long last the CBI will reach to Modi through the ‘disgruntled’ and ‘undisciplined’ officers of police department and intelligence wing. Another flicker of light is Advani’s an agnorisis in narrating what he said to Kamla Hassan on June 9, 2013 when the BJP executive conclave was electing Modi as the chairman of the election campaign 2014. "The story is about a meeting Adolf Hitler and Benito Mussolini had during the Second World War, in which Hitler tells the Italian supremo that the sins committed by the two of them would prove very costly for them after death. When Mussolini said to his friend that so far as he was concerned, when his own end came, he would go to the Vatican and seek help from the Pope who was believed to have a pass for Heaven, Hitler asked him to commend to the Pope his name also," Advani remarked further that "the story ends with both the Fascist leaders landing in Hell, and only the Pope reaching Heaven." The events may take a dramatic turn if the Supreme Court serious asks the so called disgruntled cops to present the whole matter of the cases for a comprehensive assessment as to who was behind the murders of Ishrat Jahan, Haren Pandya as well as the pogroms. There is still some meaning in what the Congress spokesperson Shakeel Ahmed twitted in this regard. "Advani hints in his blog that you have to pay for your sins in your lifetime itself. Is he repenting his role to save Modi in 2002?" The roguery of state in the Indian Union is nuanced from the United States, Somalia, Indonesia and a host of other countries. In India how a state government applies a rule of law or ignores it in discrimination based on the local composition of the population. For example the J&K government can order retrial of a case or exhume bodies of innocent killed and appeal for harsher punishment to those who are found guilty irrespective of the religion of the guilty. In Gujarat of Modi a different system of judicial dispensation and police administration came into practice. Maya Kodnani deserves hanging at the gallows but the state government does not want it at all. Even after deciding to appeal against her in the high court the government balked from it. The government of Modi is still willfully refusing to pay equal compensation to the families who lost their members in the pogroms. The government has not budged to concede to the Muslims the concessions sanctioned by the central government with the recommendation of the Sachar Commission. A judge(Dholskis) had told Babu Bajrangi that he would sentence him to hanging for several times for the enormity of killing nearly 800 Muslims in Naroda Patia. Modi not only changed the judge but kept on changing judges until judge Akshay Mehta came who agreed to give him bail. Snooking his nose at the world opinion Modi appointed Mehta as one of the judges inquiring into the genocide cases. What more roguery can the state of Gujarat under Modi practice than the chief minister himself harboring Bajrangi by allotting him the Mount Abu state guest house to cool his heels after having killed Muslims like Rana Pratap? Such is the topsy-turvy world in India that there are groups clamoring vociferously for Modi to take the reign of India and rule the country! One such group organized a concert in Delhi and a participant Shilpi Tiwari declared “He is the perfect candidate because he has shown how rogue elements from both sides (Muslims and Hindus) can be reined in so that his state could prosper. That’s the template India needs.” In the light of Modi’s dispensation in Gujarat 2002 he is a rogue himself so how could he control rogues on both the sides of the great divide in India? In fact he had decided in the late night meeting of February 27, 2002 that he would forever tilt the equation between Hindus and Muslims in favour of the Hindus for good. Thus the subversion of law and order under his dispensation constitutes Gujarat as a rogue state. Evidence since then in other cases multiplying exponentially support this belief. And the concert in Delhi on the eve of the conclave meet in Goa included the proven rogues of Indian society. There was Tejinder Pal Singh Bagga with a long record of attacks on such proven secular Arundhati Roy. Another figure in the same cast as Bagga was Suresh Albella was a winner of The Great India Laughter Show on telelvision. His macho jokes include the one that he as usual lifted from the RSS texts on nationalism. “Jaane kis din Lal Kille mein mardangi bhasha bolengee” (God knows on which day we will hear masculine language spoken from the Red Fort). In the same vein he remarked about the Prime Minister Mohan Singh, Dr Singh “remained silent like a teddy bear unless he was prodded by the high command.” The intention and perception of such people in pro Modi camp speaks volumes about what they expect Modi to do if he really dons the mantle of the prime minister. Already the postulate towards which the momentum of BJP campaign is moving is for a strong president to head Indian government and not a parliamentary democratic prime minister. The move to make Modi PM is fraught with danger to all and not just Indian Muslims. He is autocratic, self willed, and intolerant of opposition to him. The Gulbarga society pogrom in which Ahsan Jafri was killed was the personal vendetta quintessentially. Ahsan Jafri had opposed him and had warned the voters including Hindus that Modi was tainted with RSS hate and divide ideology that bodes ill for the country. Modi did receive the last call from the MP and refused to save him, nay, he abused him on the phone. The people sheltered in the house heard it. This could be the other Achilles heel if the Jakia appeal in the apex court is allowed to proceed fully and the real culprits tried and punished. The third instance of the Achilles heel is who is behind the murder of Haren Pandeya. Since these events Modi followed a policy of what today Edward Snowden the NSA whistleblower describes: “They say it is better to kick someone out of a plane than let these people have a day in court. It is an authoritarian mindset in general." The same mindset led to the murder of the Muslim who was eye witness to Naroda Patia atrocities and had found a mobile phone of the satrap leading the attacks. Now it is time to turn back to Jaitley: “Coming back to the Ishrat case, the CBI arrested some officials of the Gujarat police. They were released on bail since the charge sheet was not filed within the statutory period. Since the participant in the liquidation of the module was a Central intelligence agency, the CBI has now decided to uncover the functioning of the intelligence bureau. The cost of the Modi-phobia will now be paid by the intelligence bureau. Its senior officials will be grilled. They will be asked details of their intelligence collection methodologies. They could be questioned on the legalities of the means deployed by them to collect intelligence. They will be asked questions with regard to the authenticity of the intelligence which is collected. Motives could be attributed to them for having collected materials against the Lashkar-e-Taiba and passed it to the Gujarat police. Only Pakistan and LeT would have the last laugh. The myopic political regime in Delhi has not realized the significance of destroying institutions. Harass Gujarat government even if it means destroying India’s security apparatus, the object of the Congress party is clear.” This circumlocution constitutes what Albert Camus says: lie is telling more than the truth. Jaitley calls the murders of four including Ishrat Jahan as “liquidation of a module”. Little does he know that it was not a module! These were different people unknown to each other and killed and dumped together. Two of them were not even Pakistanis as claimed by the Gujarat police. Exposing the link that leads to Modi from Vanzara is not what Jaitley mistakenly or tongue in cheek thinks is “uncover(ing) the functioning of the intelligence bureau” [as Snowden has done in the case of the National Security Agency in the US or as Shamiur Rehman has done about the “create and capture” theory of framing Muslims from the mosques in America by the New York Police Department, NYPD]. Regarding the questioning of the legalities of intelligence g athering which Jaitley fears, Vice Presiden Hamid Ansari is on record in recommending a supervisory committee of Parliament to oversee the intelligence gathering. He was not speaking at the rock concert of the Constitutional Club of Delhi but at the Kao memorial lecture. Jaitley’s fear is that of Advani in the past and the Hindutva for all the time. They want to use intelligence gathering to shield Hindu extremist perpetuating terrorism. This is the old way and the new is different. Highlighting this difference Farrukh B Hakeem, MR Haberfeld and Arvind Vermas observe in their book Policing Muslim Communities:”Globally, scholars of policing have witnessed a shift in focus from the traditionally reactive, law-and-order and crime control model of policing to one that is more just and equitable and is accountable to the community so as to ensure support.” This is well illustrated in how Advani, Bal Thackeray and others rushed to support Sadhvi Pragyasingh Thakur and the army’s hesitation to name the remaining dozen officers involved in terrorism in addition to Lt Col Prasad Purohit and also the attempt of national security advisor MK Narayanan to forestall investigation in the Samjhauta Express attack and Modi’s own brazen attempt to put hurdle in so many cases of which Satish Verma’s pioneering finding in Ishrat Jahan case deserves attention. This is corroborated in Modi trying to placate GL Singhal and others in the Ishrat Jahan case and CBI’s doing another turn of favour to him, Singhal and his group. To crown their role in the fake encounters and the pogroms, DG Vanzara claimed that it was the work of the brave men, mardon ka kaam. So the rogue state of Gujarat was engaged in roguery which they perceived as deshbhakti or patriotism. At long last Modi is still at it when he targets the central government by leveling such broadside that National Counter Terrorism Centre or NCTC is a poorly conceived idea. “It is not clear how big it is going to be, what forces are going to comprise it, how exactly it is going to function and which statute will it derive its powers from. I think such poorly conceived ideas which tinker with age old existing systems rather than strengthening them are going to do irreparable loss to our internal security apparatus.” In reinventing himself as a hero from his past villain role he is disregarding the inventive venture in true policing. So within one decade he has become a hero! How? Or rather to borrow the mythology from the remark of Advani on Modi’s elevation: how could the villains of the past: Hitler and Mussolini(Vajpeyy/Advani/Modi) have become Arjuna/Bhisma Pitamaha of today? A rogue is a rogue forever. However, the perception of Jaitley is more sinister because he has spun a brand new theory to save rogue ruler Modi by blaming the disgruntled police officers to have superseded Modi in conducting the affairs of the state without the knowledge of Modi. From the murder of Haren Pandya and the pogroms down to Sanjive Bhatt’s disclosures of truth they are responsible and not Modi. This is strange in the sense that Modi relied on the spy network of Shivaji. He knew every movement of Haren Pandya and what he said and did. When did the disgruntled police like RB Sreekumar, Sanjiv Bhat step in? The phone of the main public prosecutor was connected with the home department of the state government of Gujarat. The Home Minister of Gujarat is and was no other than the Chief Minister Narendra Modi. This was the case in the night of June 14, 2004 when Ishrat Jahan was killed. Her dead body with those of the others would be dumped at the fake encounter spot several hours later when it would be morning wee hours of June 15. As if this was not enough the phone of the main public prosecutor Sudhir Brahmbhatt had been in direct line of communication with the home ministry for days together. Thus this single instance of crime against humanity emanated from the home ministry of the state of Gujarat. The Crime Branch and the main public prosecutor were also in league. During the pendency of the case the branch wanted the case to be closed in unseemly hurry but the prosecution was lingering it with the excuse that the absconders in the case who helped Ishrat Jahan were not traceable. How could they when they were incarcerated in a Jammu and Kashmir jail. The police officers making investigation into the fake encounter were DySPs Narendra Amin, Tarun Barot, J G Parmar and police inspector Bharat Patel. They did not bother to take into custody the absconders who were very much available for prosecution in the jail in J&K. Furthermore the four were also not arraigned as accused. This is quid pro quo in which the consent of thehighest police officers like Commissioner of Police Kaushik and Modi was inevitable. Modi may be too sharp to go on record but then this give and take in such a serious matter cannot be done without his consent. But Ali is still in prison, now in Visakapattham in Andhra Pradesh. Widow of Pandya, Jagruity had deposed great hope during the Sadhbhauna of Narendra Modi that the BJP top leader LK Advani would get justice to her bereaved family without knowing that Advani was in the same business as Modi. Advani was still the mentor of Modi and as home minister in March 2003 he could not have taken trouble to okay the Gujarat government to seriously investigate Pandya murder case. Then came the arrest of Sanjive Bhatt for his affidavit that PC Pande and may be Modi were involved in the murder of Pandya. This was based on the letter that Asghar Ali had given the chief of the Sabarmati prison, Bhatt. In the letter Ali had told him that it was not he but Tulsiram Prajapati who had killed Pandya. Sabamati jail authorities were cohorts of Modi and Bhatt had moved to another posting. The widow of Pandya was denied permission to visit Ali all the eight years he had languished there. Then she came to know that he was in Vizakhapatnam jail and travelled there and met Ali on June 12, 2013. She discovered the truth of the horrifying murder of her husband shot through his testicles. Her father in law Vithalbhai had always contested that his son was not killed by LeT but he was a victim of ‘political murder.’ Pandya fell as another victim at the behest of Modi. When Advani failed to deliver justice to the widow and only persuaded her to call off her protest at the Sadhbhavna site of Modi in 2012, she still felt that her party BJP would come in her support. But Modi saw to it that even the election in December 2012 which she contested subsequently was inane. He saw to it that she would lose and she lost. But more disturbing exposure in Ishrat Jahan case regarding bogus IB inputs finally opened the way for her. Modi was a morbid figure for he had left Joshnabehn, his wife, in the oblivion of a village ensconced from the prying media to pose as a brahamchari ala Vajpayee and the RSS pracharaks. Chapter 6 Modi’s suborning the state to hide the crimes against humanity Narendra Modi government was proactive in penalizing Sanjive Bhatt, RB Sreekumar, Satish Verma and other senior police officers in a revengeful attitude because they did not toe the chief minister’s official line of suppressing the truth about the pogroms and the fake encounters. The main thrust was to bribe or coerce officials of all ranks to follow the Government’s manifest policy of spreading lies that Muslims needed to be punished for producing more and more children which threaten to thwart the development of the state, that they were criminals, that they were terrorists. Modi was filled with hubris that the voters had given him mandate to punish the Muslims. They were second class citizens and should not be pampered but violently put down. Chapter 7 The Newtonian law of Moloch Modi Modi’s standardized theory was the third Newtonian law of action and reaction. They fail to their predetermined doom because of the hate ideology of the RSS pracharatks and those in the high positions like the special director of IB Rajendra Kumar a close pal of the chief minister of Gujart. The linking of Gujarat fake encounters, the pogroms there in 2002 with the events in Malegaon and UP point out clearly a much larger conspiracy involving IB as the mastermind of anti Muslim design to frame Muslims in bomb attacks that were actually mounted by extremist Hindus. As the state of Maharashtra and the state of UP did, Gujarat went further for having staged a genocide and fake encounters with temerity by subverting the state and central government agencies. Mostly eloquently illustrated is the plea of Ishrat Jahan’s mother’s letter in this regard: My daughter Ishrat Jehan was abducted, illegally confined and killed in cold blood by officers and men of the Gujarat police, in June 2004. She was killed as part of a larger conspiracy which had a political agenda. Ishrat’s murder was projected as an ‘encounter’ and justified by branding her a terrorist who had come with 3 other men to attack the Gujarat Chief Minister Narendra Modi. This was not the first fake encounter in Gujarat, other Muslims too had been executed in similar staged encounters, committed in the name of protecting the Chief Minster of Gujarat. Some of these other fake encounters, which are nothing but pre meditated extra judicial killings, are already under investigation and prosecution. My young college going daughter, Ishrat, was studying and working to earn and support her brothers and sisters, after the death of her father. Since the day of her murder, I have been statingthat my daughter was innocent and had no links whatsoever with any terrorist or criminal activity. The same was categorically asserted by me in the Writ Petition filed by me in August 2004, before the Gujarat High Court, seeking a CBI enquiry to establish the innocence of my daughter and justice through punishment of her killers. For 9 long years the Gujarat state, has abused its power, to obstruct, delay and derail the investigation, so that the hands and masterminds behind this heinous crime are shielded from legal accountability. The State of Gujarat and its senior IPS officers have filed frivolous and vexatious petitions in the Supreme Court, coerced witnesses, and deployed many other unlawful tactics. My lawyers have resolutely met each challenge and worked to uncover the truth. The report of the judicial enquiry by the Magistrate Shri S.P. Tamang, in September 2009, concluded that my daughter was innocent and had been murdered by Gujarat police officers and men. The SIT appointed by the Gujarat High Court, under the Chairmanship of Shri R.R. Verma, too concluded in 2011, that the encounter was fake and not genuine and that Ishrat Jehan had been killed in prior custody. Under directions of the Gujarat High Court the investigation was transferred to the CBI and a FIR for murder and other grave crimes lodged in 2011. The CBI is investigating the murder of my daughter and 3 others. This investigation is being monitored by the Gujarat High Court and a status report of the investigation is regularly filed before the High Court. I have always placed my faith in the Court and pray that the Hon’ble High Court will ensure that my struggle for justice is not in vain. The CBI investigation has already led to the arrest of many senior Gujarat police officers and men. The CBI investigation has revealed that complicit in the staged fake encounter of Ishrat and 3 others in 2004, were not only police officers of Gujarat, but others as well. The evidence collected by the CBI, as expressed to the High Court on the last date of hearing i.e. 14th June 2013, points to a larger conspiracy. The conspiracy appears to include Mr. Rajendra Kumar a senior officer of the Intelligence Bureau. The CBI counsel stated before the High Court on 14th June, 2013, that their investigation shows that IB Officer Mr. Rajendra Kumar not only knew about the illegal detention of my daughter Ishrat but was directing the operations. I am astonished and distressed to hear that attempts are being made to protect Mr. Rajendra Kumar from arrest and custodial interrogation by the CBI. I am also surprised that the media is projecting the CBI investigation as an attack on the institution of IB. To my mind, what is worrying, if not dangerous, for the security of India, is if high ranking officers in institutions such as the IB, abuse their position and fabricate information, to advance a communal and politically motivated agenda. It is in the interest of the country if such people are weeded out of the IB and the security of all the people of India protected. Clearly, the investigation of the CBI is moving in the right direction and to thwart it a very crude and motivated move was orchestrated, by planting some audio-tapes with a private media channel viz. Headlines Today. There is not a whisper of allegation against my daughter Ishrat Jehan in these so-called IB audio recordings. Significantly the timing of the broadcast of these tapes, on 13th June 2013, by a compliant private TV channel, the night before the hearing by the High Court, not only makes them highly suspect, but in fact betrays that they are desperate to shield the guilty. I would like to state here that my lawyers will be sending a legal notice and will initiate appropriate legal action against Headlines Today TV channel for the false, scandalous and defamatory statements made against my deceased daughter Ishrat Jehan. When the next day the Additional Advocate General of Gujarat, brandished these planted and concocted CDs before the High Court, on 14th June, 2013 and made specious arguments for them to be taken on record, the nefarious design and purpose was clear to all. The Gujarat High Court not only rejected this fallacious plea of the State of Gujarat, but also sternly reminded it of its constitutional duty to protect its citizens and admonished it for continually obstructing the investigation into the staged encounter. I strongly reject and denounce each and every allegation and statement that refers to my deceased daughter Ishrat Jehan as being a terrorist or having any links with any terrorist activity or group. In the past too attempts have been made to taint the name of deceased Ishrat by planting false, concocted and baseless news reports. What is significant is that the judicial enquiry and impartial and professional investigation have always upheld the innocence of Ishrat. The State of Gujarat has on each hearing before the High Court argued strenuously to disrupt and disturb the CBI team that is investigating the killing of Ishrat and others. As I observe the progress of this investigation, I ask the following questions. Why is the State of Gujarat so keen, almost desperate to remove Mr. Satish Verma, IPS, from this investigation? What does the State of Gujarat fear this diligent and honest investigation will reveal? Who are the persons the State of Gujarat is trying to protect? I have a right to know the complete truth – who killed my daughter Ishrat Jehan, who masterminded her murder, who stood to gain from the cold blooded killing of a young Muslim girl. I have a right to complete justice, and for that it is necessary that the entire conspiracy is unearthed and all those responsible for eliminating my innocent daughter are indicted, charged prosecuted and punished. The main difficulty facing Muslims and fair minded majority Hindus and other members of all religions residing in the country is that knowing full well the complicity of the Gujarat government especially under Modi they see no hope of justice will ever be given to the innocents and hence the need for impartial international investigation by UNO or NGOs and even the US. Broadly the case of Ishrat Jahan defies a resolution in a trial court because of certain facts. 1. Nine years have passed and yet the courts have not decided whether it is only a fake encounter in which an innocent college going Muslim girl and three others were kidnapped and kept some days before being killed and propagated by the state police as a suicide bombers going to kill the chief minister Modi. Or whether to take up the case as the girl and three others as terrorists and then resolve the case. Currently the trial court is interested in one aspect that it was or was not a fake encounter. 2. As the case is in a series of other fake encounter cases preceding and following it there is clear design behind them. The chief minister stands to get full credit and votes for having the alleged terrorists killed. Modi has vaunted the murders as feathers in his crown and won three general elections of assembly and parliament in which the genocide of Muslims and the fake encounters have by no means played a mean role. This is beyond the purview of the courts that tried the case or other cases. So the crying need of the hour is a different kind of court like a grand jury or International Criminal Court that can comprehensively take the case in its entirety and the prevailing weltanschauung of innocent Muslims who have been hunted and haunted and either killed in fake encounters or left to languish in prisons for decades together and in some cases like Himayat Baig sentenced to death though innocent of the crime for which this death sentence is passed. 3. The central government’s involvement cannot be ruled out. The premier intelligence agency Intelligence Bureau comes directly under the control of the central government. For four years till 2004 it was a government whose prime minister and home minister were from the Hindutva extremist groups and members of the RSS which the US considers as a terrorist organization. India neither considers RSS as terrorist nor does it view genocide or fake encounters as terrorism. To break this impass impartial and judicial intervention is also necessary. Ishrat Jahan can be killed if she is a terrorist because she is a Muslim but Tulsiram Prajapati cannot be called a terrorist because he is a Hindu. He had killed the Home Minister Haren Pandya which many now know was at the instance of Modi. But innocent Muslims like Asghar Ali and eleven others had to spend more than eight years in prison on false charges. India has failed to wake up and take note that slapping multiple bogus charges is detrimental to the Muslims. Asghar Ali is still in prison in Visakhapatnam for other bogus charges. So Ishrat Jahan and Asghar Ali have suffered mass atrocities at the hands of the judiciary and the police and there is no end to this process. In contrast the killers of Ishrat Jahan, mainly police officers of rank, not only enjoy luxurious treatment in prisons but full support of the state and its prosecution. Many of them in prison for more than six years but have their salary paid to their families. 4. The false input on terrorism had been emanating from the IB. IB also fed the false information to the American FBI. This is at least the case in Ishrat Jahan and the three others killed with her. But then IB joint director of 2014 Rajendra Kumar also issued bogus input against the Home Minister Haren Pandya. Jagruty believes that it was the input generated by Kumar that led to her husband Pandya’s death. Her father in law called it a political murder and Modi was directly involved in it. It is also now known that Kumar was in touch with the group of police officers and their men on the day of the operation until the very end. He must have been in touch in regards to Ishrat Jahan case. Why was the call records of nine years ago destroyed over such a sensitive matter? Where did the police then get the call records with conversation that the prosecution wanted to submit to the court? The court refused to take it on record and asked the prosecution to give it to CBI. If true why only selective records saved and the rest destroyed? Chapter 8 Hindutva ideology as motivation The IB chief Asif Ibrahim’s poser why an official in Kumar's position would collude in a fake encounter when he would not be up for any recognition, credit or a gallantry award given the secret nature of the role of the agency's officers in such operations, is tongue in cheek remark. It shows he is a poseur. He is affected by the culture of officialdom in India. Kumar is like uncountable officials of intelligence and police who have profited from framing Muslims in terrorist charges and getting reward and promotion. The moment they catch or kill any deemed terrorist it is applauded in the media and the government honours them with promotion and enhancement in pay packet. This is a routine affair. Kumar was a joint director in 2004 and is now a special director of IB. How could Asif Ibrahim say that he could not collude with the Gujarat police because he was from Madhya Pradesh cadre? Two years before Ishrat Jahan murder he was also involved in another conspiracy. He it was who had advised Modi to consider the Godhra fire incident as a terrorist attack by ISI. The collector of Godhra had described it as accident and the Railway Minister appointed commission under justice UC Banerjee maintained that it was accident not an attack from outside. Kumar as IB senior officer at centre had tried to “cajole” the State Intelligence Bureau chief of Gujarat RB Sreekuma to accept this line of investigation. This is how Kumar had planted this conspiracy theory then and the result was the state sponsored genocide of Muslims. More than two thousand Muslims were killed during the pogroms let loose on them by Modi giving the avenging Hindu extremists to finish marauding within three days. In the same way it is also pertinent and disturbing to note that the HC has pulled up the CBI for "focusing more on the genuineness of the inputs" provided by IB rather than "concentrating on ascertaining if the encounter was fake" or not. The fake encounter was the logical result of the fake input by the Intelligence Bureau. Why does not this logical syllogism followed when the chief minister felt proud in the Newtonian action and reaction theory in regard to Godhra fire incident. Let us remember well that Modi often asked his audience in election rally whether he did right in getting terrorists like Sohrabuddin and by implication Ishrat Jahan got liquidated and his audience cheered him saying that they wanted him to do just that. No court in India is prepared to take up this angle in deciding what was and is happening in Gujarat. This is the reason why nine years after the fake encounter now there is so much hubbub over it. The British solved the underground railway bomb attacks case most efficiently within a short time and so did the US in the Boston Marathon attack. Why does India lag behind in this? It is primarily because where Hindu extremists are involved in terrorism the police and the intelligence agencies cover it up and prepare a parallel case in framing Muslims in their place. No Muslim could dare to breach the zed security cordon around Modi and yet scores of innocent Muslims have been either killed in fake encounters, imprisoned or framed in bogus cases. Ishrat Jahan was in police illegal detention for several days and the others were also in prison so the question is how could they be on the way to kill Modi? There was no case against any of the four killed. They were not involved in terrorist activity or any criminal acts. Had they been involved why have not the police found out any such case? This indicates a high level all India conspiracy which the police and the court want to shun in investigating or trying in a court of law. This humongous failure has turned India into a rogue state rather than just Gujarat. And by his the implication is that the law and order has been subverted to suit the Hindutva ideology. Kumar and Modi were from RSS and had close relationship in their tenure in Chandigarh. It is also relevant to see that Ishrat Jahan also fell a victim of terrorism in 2004. There is also confusion (or collusion?) over alert and input. Malegaon has shown the classic example that the police control room received intelligence and declared alert on September 1, 2006 that there would be terrorist attack. Police check posts with gates of electronic detection of weapon and gun powder were installed at many places. Exactly a week later the attack came. The Muslims were blamed and nine of them were imprisoned. More than five years later it is now clear that the Hindu extremists including the RSS pracharaks or leaders were behind the blasts of September 8, 2006. Was the input of IB followed the same method? A CBI officer remarked: "The IB alert regarding them may be genuine and they could have been LeT terrorists. But the proof we have is that Kumar's role went beyond generating that IB input and that he was involved in the preparation of the fake encounter till its very last stage.” Kumar does not deny preparing the input but he claims that he did not ask the police to rush to arrange a fake encounter. But the CBI officer is confident that in this Kumar is lying that he went much further and gave Ak 47 and prepared the details till the fake encounter was executed. That he was connected through to the chief minister for nearly 40 phone calls is also valid. The alert in Malegaon and Ahmadabad led to actual incidents of terror is beyond doubt. The trial court may take some time to hear the case of Ishrat Jahan even if the Central Bureau of Investigation submits its report by July 4th, 2013. However what is clear as of June 21, 2013 that Modi was involved and his mastermind as in the Godhra incident was again IB officer Rajendra Kumar. Kumar met Ishrat Jahan before she was killed with three others. The guns used in the killing also came from the SBI of Gujarat unit. Kumar was in charge of it. Thus it proves the mother of Ishrat, Shamim, true that Modi was hundred percent involved. What for was he in touch with Modi the whole day of the fake encounter? Is there any court in India including the Supreme Court that can take cognizance of the emerging facts suo motto and try Modi before he becomes the Prime Minister and escapes justice? Even so the facts lead to the most startling denouement of the whole decade. Genocide of Muslims took place with the input of joint director of IB Rajendra Kumar. He it was who changed the fire accident in S6 coach of Sabarmati Express on February 27, 2002 at Godhra into a sabotage of ISI and that Modi used it to call strike and let Hindus take revenge on Muslims. By watching the mass atrocities on Muslims during the pogroms they were emboldened to venture into fake encounters. Modi and Kumar/Amit Shah behaved like the King and the Duke in Mark Twain’s masterpiece The Adventures of Huckleberry Finn. Their cheatings led them to perform a show they advertised for the gullible public as Royal None Such! Amit Shah was the junior home minister to the home minister and chief minister Modi. Thus Modi knew and approved what Shah and Kumar were doing. Kumar and Shah ordered the fake encounter. (Shah had also ordered the kidnapping of Sohrabuddin and Kauser and Tulsiram Prajapati from the bus intercepted at Sangli, Maharashtra, on the way from Hyderabad.) This allegation is made by GL Singhal who along with others shot and killed the four. That Kumar was also in the illegal detention centre room where Ishrat was tortured and then killed must have been known to PP Pandey and Kaushik. Pandy is still absconding and may have told this to CBI or Kaushik Commissioner of Police in Ahmadabad. These must have figured in the talk with Modi who was in touch with Kumar during 37 phone conversations on June 15, 2004.. As the Home Minister Modi is constitutionally bound to have known the premeditated murder his deputy Amit Shah was ordering in connivance with the IB officer in charge of his state of Gujarat. The CBI questioned Kumar on June 18, 2013 and since then Modi in charge of the election campaign of his Hindu party BJP and his deputy again Amit Shah as secretary of the party have shown a subtle shift in their public appearance. Modi dropped his idea of going to Ayodhya not because he was afraid of the polarization the voters but because he was a real time avenger and knew what the intelligence set up and the inquiry agencies were up to. They stand as unrobed as the King and the Duke. It would not be long when the public would flock to their rallies but they would have enough rotten eggs and stones in their hands.For the rogues deserve what the King and Duke deserved. In the meantime the plot thickens. There were two phone calls from a public booth, one to the Ahmadabad SIB and another to Shaikh Ghulam Javed (Pranesh Pillia) within an hour of the same caller speaking to SIB Ahmadabad two days before the encounter. Rajendra Kumar was the mastermind as far as the fake encounter of the four is concerned. He generated three fake inputs and was present when Ishrat was brought to Ahmadabad and shot dead with the others. That Amit Shah told GL Singhal and the others to execute his order makes him the clinch pin in this case also as he was in the case of Sohrabuddin, Kauser and Prjapati case. Singhal and his associate police men not only killed the four with the weapons borrowed from IB but also planted them on the dead bodies showing them to be terrorists on the way to kill Modi, Advani and Togadia. Fearing that the higher ups would escape and leave him in the dole drums in case of exposure, Singhal chose to be the Albratross hanging from the neck of Modi. He made an audio recording on November 20th 2011. In this new evidence the new state home minister Praful Patel is discussing with Advocate General Kamal Trivedi, Additional Advocate General Tushar Mehta, Additional Principal Secretary GC Murmu, another lawyer and Singhal how best to cover up the fake encounter and sabotage the case in the trial court from within to save the officers involved. This Patel must have undertaken at the behest of no other than Modi. This incident surely may remind you of how Modi had also tried to sabotage the PIL filed by Malika Sarabhia in the pogroms at Naroda Patia where 800 Muslims were brutally burnt alive in a well. He had ordered RB Sreekuma boss of SIB to hand over to his deputy Sanjiv Bhatt ten lakh rupees for the task. Any more delay would have justified Shamima Kausar’s claim for CBI inquiry into the matter. So the Modi government asked the Chief Metropolitan Magistrate DM Patel to quickly complete the inquiry. He asked judicial magistrate SP Tamang to do it and sent all the relevant documents, forensic reports and FIR etc to him. Two days after Tamang made his findings known to the public Patel was transferred as a punishment he did not deserve. Shamima considered the Tamang findings as a godsend. Tamang had disclosed that the AK 56 and 9mm pistol had sprayed 70 bullets that ended the life of Ishrat Jha and the other three. But the weapons with which the four alleged LeT terrorists attacked the police were with them, on their dead bodies and they were the weapons that had spewed death. But no bullet was found on the site. Nor was any police even slightly injured! How could all this be? It finally turned out that the police had used those weapons to kill the four and plant the same on their bodies. Of course DG Vanzara and his men were over confident that it was state policy to kill Muslims blaming them to be terrorists and they didn’t bother about the logistics and the forensic aspects of the two guns. The insouciance of the loyal police officers is buttressed by the Director General of Police of Gujarat K Chakravarthy when he had called State IB chief RB Sreekumar and told him that the state wanted such encounters to go on. Sreekumar told Tehelka: “Chakravarty told me that [the then Gujarat Chief Secretary]Subba Rao had told him that some Muslims should be eliminated. I told Subba Rao that if there is an encounter, I will do an inquiry and speak out against my colleagues if I find the encounters are fake.” For this Sreekumar’s stint in office ended, he was head of intelligence between April and September 2002. This conversation shows that the fake encounters were coterminous with the genocide of Muslims and both were state policy matters of which the architect was Modi as I wrote in my book The First Hindutva Genocide of Muslims and its Architect. That policy has continued as the cases of fake encounters multiplied and also the elimination of vital witnesses in the pogroms by means of hired assassins and extrajudicial killing. Another discrepancy in Ishrat Jahan case was that the four were killed in sitting position and not on their feet in action of attacking the police. The police claimed that the encounter had taken place at 4 am of June 15, 2004 and the postmortem was done at 4.30 pm. At that early hour the rigor mortis had set in that means they must have been killed 12 to 24 hours earlier. Moreover the rice the four had eaten was in advanced stage of digestion. So they were shot dead much before 4 am. When all this was coming to light in 2009 IB officer Rajendra Kumar told home minister P Chidambrum that it was a “genuine encounter” and the Ministry for Home Affairs declared it so. The American agency FBI also relied on this. Before August 12, 2009 when Judge Kalpesh Jhaveri was to resume hearing the case the central government submitted its affidavit that the encounter was genuine. Till Tamang published his findings Gujarat government had not bothered to say that the encounter was genuine nor did it oppose either the formation of the SIT ordered by Jhaveri. Tamang interlude brought about a chemistry of change. A lawyer associated with the case remarked: “If there had been no Tamang report, the SIT could well have found the encounter genuine basing it entirely on the intelligence inputs.” 1 Till then the clutch of pliant police officers enjoying confidence of the chief minister rested assured that all was well as long as Modi was in power.

The fake encounter numbering 17 ended with the arrest of Vanzara but the extrajudicial killing of vital witnesses in crucial pogrom cases continued. The fake encounters began in the first week of October 2002 with the cold blooded murder of Sameer Khan Pathan. First instance of fake encounter by state policy. Its victim Sameer Khan. An inquiry by Inspector General (Human Right) Tirth Raj was made. Raj said that “Everybody was involved in the cover-up [of Sameer murder]—from the DGP’s office to the Chief Minister’s Office.” Read office as according to the order of the Chief Minister who would usually tell his office people to do his bidding in order to distance him from direct complicity which of course it is nevertheless. Genocide and fake encounters are the two sides of the same coin minted in the Hindutva laboratory of Gujarat and similar bodies elsewhere in India. For example the Hindutva ideology calls for aggressive terrorism as implied by the words of the chief secretary and the director general of police of Gujarat or by the most famously made sentence of the police officer stationed at Naroda Patia KK Mysorewala who refused to help the Muslims of Naroda Patia telling them that there was order from above not to save the Muslims. The Human Rights Watch made Mysorewalla’s sentence as the title of its report on the pogroms of 2002 and thereby crystallizing the fact that it was state policy to kill Muslims. So far no court in India has taken cognizance of the state policy and tried Modi in a court of law for having put the policy into practice. Even so when the policy has inter-state or national dimension. RSS Pracharak Sunil Joshi followed the same policy. The Railway Minister Lalu Prasad Yadav had appointed a commission of inquiry into the burning of the Sabarmati Express at Godhra on February 27, 2002. Judge UC Banerjee made the inquiry and found that the fire in compartment S6 was an accident. This invalidates the theory propagated by Modi and Rajendra Kumar that it was a terrorist attack. Sunil Joshi along with one accused in Malegaon case went to Kolkata to do surveillance of the house of Banerjee and kill him. Joshi also conspired to blow bombs at Malegaon and many other places. He had killed a Congress leader and his son and went in hiding at the ashram of Swami Asimanand in Gujrat. Asimanand paid Joshi 25, 000 rupees to blow bombs at Malegaon in 2006. A part of the money came from the huge sum Modi had gifted to the Swami from state treasury. Jayanti Gohil and his son Ramesh Gohil along with Harshad Solanki were involved in the pogrom at the Best Bakery in Vadodra. They were also behind the bombing of the Muslim shrine of Ajmer. They were also involved in the murder of Sunil Joshi when the RSS strongman Indresh Kumar felt that Joshi knew too much and could spill the beans. In this gestalt of violence and terrorism Modi and Gujarat figure prominently. Bharatbhai Riteshwar and Asimanand lived in Gujarat and so did Sahvi Pragyasingh Thakur. So the Gujarat-under-Modi angle is sinister and calls for a more comprehensive investigation than is the individual cases of terror or fake encounters now being heard in the courts show. Genocide, fake encounters and liquidating crucial witnesses in the pogroms all figure in the state policy and so does the boycott of Muslims and denying them the monetary benefit provided by Sachar commission recommendation. On November 5 2011 a very important source of evidentiary value was removed when Nadeem Ahmad Sayyad was killed. He was due for court hearing in the Naroda Patia case. He had the mobile no. 9825054777 of Ashok Sindhi picked up from the scne of violent murders of Muslims. Ashok had played a leading role in the massacres. The attack on the car bringing Shamima, mother of Ishrat Jahan in Mumbra, Mumbai, could have killed her as two motor cycles with armed men rammed the car one after another. The window panes of the seat on which she was sitting were smashed but the motorcycles crashed into the car. A man was serious injured his companion with a gun escaped from the scene. On June 18, 2002 Shamima Kauser attended court hearing in Ahmadabad along with two corporators of National Congress Party Rauf Lala and Munna Sahil. In Ahmadabad the police had threatened them with dire consequences. Both of them are close to Jitendra Ahvad MLA from Mumbra who has shown keen interest in Ishrat Jahan case. But the commission of police in Thane is one of the cops who has gathered such notoriety in framing innocent Muslims in terror charges denied that it was sabotage. KP Raghuvanshi also dismissed the episode as if it were traffic accident. He and Rakesh Maria were in great position in Mumbai police force when young lawyer Shahid Azmi was killed. Having gorged on the fake encounter victims’ cadavers it looks clear in the sky that the vultures are returning to the city, proving the Indian adage right that their end is near. In less than a week the sky would be clearer than today. But as of now Narendra Modi, Amit Shah and O P Mathur have run out of their time. The national in charge of the BJP, the UP in charge and the city in charge respectively of the election 2014 have reached the end of their wit. They will have to wind up their campaign for good as the huddle they have gone in will lead them to the abysmal depth of the evil they have committed. Along with them others will not be far behind to meet their end. Ishrat Jahan’s mother always wondered why her daughter went to Ahmadabad. It is now clearer that she had a call from Pranesh Pillai or Javed Shaikh who was employed by the joint director of IB Rajendra Kumar for snooping. 1 Pranesh must have had the ID etc of Ishrat and must have told Kumar of all these and more before he took her in his car. The police could not produce the car in court. It was like the Arms Haul of Aurangabad and Malegaon case of May 2006 where the car in which Zabiuddin carried the explosives was never found and presented in the court. Ishrat left her house in Mumbra and went to Nasik from where the duo travelled together. Pranesh had visited his family, wife and two kids in the house of his sister in law and left for Ahmadabad. Kumar had his sleuths shadow the car and report him back. Modi’s office was also informed of the movement and the 37 calls to his office from Kumar include detailing the movement of the car leading to the fake encounter and what happened beyond. Neither Modi nor Amit Shah has any ground to deny because a clerk could not be handling the phone calls for his time pass if they were out of office. The two mysterious phone calls to Kumar and Pranesh were made by the sleuths shadowing the car. In fact Pranesh was in Pune where Kumar phoned him to come to Ahmadabad. This call of June 10, 2004 had come from the IB office in Gandhinager. This crucial talk now exposed, compelled Modi to abandon his campaigning in Utterkhand to tackle the legal implications that is bound to recoil upon him and his lieutenants. It was this that Arun Jaitley must have known when he accused the disgruntled and undisciplined police officers to have been doing behind the back of the CM and his office. But the facts point in the direction of Modi. The BJP could not shirk its responsibility. They raised Modi to the national level to confront this evolving involvement nationally to a show of rabble rousing that would lead to an upheaval. Deny how much he can but his own other ministers like Pradeep Singh Jadeja, the minister for legislative affairs, and Bhupinder Chudasama, the education minister were also present in the meeting to cover up the Ishrat Jahan case or sabotage the findings of SIT. Kumar wanted his informer Pranesh killed to remove the trace to him in the fake encounter case. Kumar had generated three fake intelligence in puts in the case and also fake reports in the case of September 2002 attack on the Akshardham attack and also the case of Godhra fire accident of February 27, 2007. Not the least important is the false in put on Home Minister Haren Pandya. Kumar went to the Gujarat State chief of IB Sreekumar and tried insidiously to cajole him to buy the argument of the accident as an attack by ISI. That led to the genocide of Muslims and a host of fake encounters. It became state policy to kill Muslims. Sunil Joshi reconnoitered the house of Judge UC Banerjee who investigated the fire on Sabarmati Express and found it accident. Thus state terrorism borders on terrorism practiced by RSS and Abhinav Bharat. Joshi was and Modi is and will remain a pracharak of RSS deny how much he would. Once a sinner always a sinner. Most of the other cases like the murder of Sadi Jamal Mahtar and Sameer Khan lead to Kumar generating fake intelligence inputs. This centrifugal and centripetal movement of state terrorism and groups terrorism has the centre located in Gandhinager which especially houses IB office of Kumar. That so much of terror emanated from the seat of power of a city where Modi also established the first national police university would sound music to the ears of foreigners. Indians are used to gimmicks. But greater wonder is he could pull woof over the eyes of the people of this great democratic country in appointing Om Prakash Mathur its first vice chancellor. He is one of those who played a great role in covering up the murders of Sohrabuddin and Kauser and others. He is now in charge of the election 2014 in Ahmadabad city. What plum posts have fallen into the hands the guilty in the land of Mahatma Gandhi! Even seemingly rational people have been taken in by the chant of development mantra. “Strangely enough the most safe place for Muslims today is Gujarat, only because its Chief Minister Mr Narendra Modi has ‘banned’ entry to the IB in Gujarat. After spending more than 40 years in the RSS , Mr Modi has now understood the games the hardcore elements in the RSS have been playing in the guise of the IB. after ‘banning’ IB, the Muslim atrocities in Gujarat have stopped. That is what is required to be done if we want to put a full stop to fake encounters, false terror attacks, their fabricated investigations and arrests of innocent Muslim boys.” 2 The moot question is: have the atrocities stopped? Can the Muslims of Ode, Sardarpura and numerous other places dare to return to their hearth and heath and resume normal life? Yes, Modi did stop grants to Sabridham hospital because Asimanand had allowed the tribe populace to drink wine and eat meat. But why did then Modi not allow the scholarships to go to the poor and needy Muslims? Why did he give half compensation of one lakh to be given to Muslims and two lakh for every Hindu killed in 2002? The world knows that he never felt any remorse over the huge casualties of Muslims and he called the relief camps as child producing factories and called the Muslims doing servicing to vehicles as dirty and obstacles to development. Implications of Ishrat fake encounter The increasing involvement in terrorism of the police in Gujarat under Modi parallels terror involvement of police under KP Raghuvanshi in Maharashtra. Raghuvanshi is the ounter part of DG Vanzara. Gujarat fake encounter seems to evolve into a much larger conspiracy that cuts across several states. Did Kumar also use ASP Rajwardhan and ATS chief Raghuvanshi through home department under RR Patil to help the RSS module of Sunil Joshi to cause bomb explosions using the Maharashtra police? Though no court has even entertained the thought of prosecuting the cases on a comprehensive national level but the common design is clearly emerging nevertheless. The International Criminal Court came into existence in September 2002 and the terror against a community comes under is ambit. Hence the imperative that just being delayed will deny justice to the victims. If the government thinks that the CBI should arrest Rajendra Kumar only after his retirement on July 31, 2013 then the government must remember that police never waited for any innocent Muslim to collect his salary of the ending month as he is the only breadwinner of the family and how would the family fend for themselves without him? Zabiuddin had called Dr Sharif to receive the arms at Malegaon. After having handed over the arms in boxes Zabi went back to Aurangabad and from there to Bangladesh and ultimately to Saudi Arabia. The consignment of explosives and arms were the bait to catch the Muslim innocent doctor and others. In Modi’s Gujarat even during the curfew hours smuggling of arms from states like UP, Bihar, Punjab, etc. continues and given to the marauders. During the pogroms “Bombs were useful in close encounters”, says Dhawal Jayanti Patel. Anil Patel says that the police delivered arms safely to the marauders in the pogroms of 2002. Why did not bother to take of such findings by Tehelka in November 2007? If he is selective in applying law of the land in favour of only Hindus in teaching lessons to Muslims and showing them their place the university he has established under OP Mathur it would teach how to suppress truth and India first rather than secularism as governing principle of the land. The India thus envisage is the Gujarat of 2002 and thereafter. Mathur and DG Vanzara and Amit Shah and their counter parts Raghuvanshi, Rakesh Maria and RR Patil and you have India first rather than secularism. Zabiuddin trapped Dr Sharif and so did Kumar trap Pranesh. The victims were police informers. Zabiuddin was a police informer from Beed. The police used him to trap an innocent doctor and then trapped Zabiuddin. The car that Pranesh drove disappeared and so did the Indica that Zabi drove from Pimpalgaon to Malegaon. Both the cars are missing! This way India first would work to delay justice which is to deny justice. What is worse once dubbed a terrorist there is no chance of proving yourself innocent. Himayat Baig was dubbed a terrorist out to attack the police academy in Nasik and now he is sentenced to death in the German bakery case of Pune. The miscarriage of justice in one case rules out the possibility of proving innocent in the other. Who generated this intelligence input of Nasik attack? It is the kind of atmosphere that the Hindutva parties like BJP and Shiv Sena had created that is making the justice and fair play out of the reach of Muslims. It is evident in the editorial of Saaman of June 22, 2013. “Cancelling the minting of coin commemorating Vaishnu Devi and minting coins in memory of Ajmal Kasab, Afzal Guru, Ishrat Jahan’s coins instead nobody has demanded. We must consider this our good fortune.” Shiv Sena took note of how some Muslims objected Vaishnu Devi image on the coin. This they feared would erode secularism. But Shiv Sena and in BJP believe that Muslims opted for Pakistan in the name of religion and hence they have forfeited their right to be equal citizens of India. “The basic question here is that the Muslim organizations have objected to the minting of the coin with the image of Vaishnu Devi, why the secularists have taken salt pills in the mouth and keeping quiet. Can either the Congress workers, or Mulayamsingh supporters or supporters of Ishrat Jahan have the courage to and pride to have the coins with the image of Vaishnavi Devi in their hands and ring/rattle them?” The Muslims want to go to Mecca on subsidy but feel stomachache to use the idol coins. A month earlier on May 22 Saamna had called the visit of Sharad Pawar to Mumbra in Mumbai where Ishrat Jahan had lived as his rape on her. Chapter 11 The gateway to Ishrat Jahan case: the role of the “grey beard” It was Rajnish Rai who had arrested DG Vanzara in charge of the crime detection branch of the Ahmadabad police located in Gaikwad House, haveli, along with Rajkuman Pandyan and Dinesh Kumar MN in the fake encounter of Sohrabuddin, wife Kauser bi and friend Tulsiram Prajapati. In his brief stint from April 1, to August 22, 2007. For this he was removed from the investigation of the case by DGP PC Pande of 2002 genocide notoriety. OP Mathur who later became vice chancellor of the rashtrya shakti university, the unique police university of India, took official punitive action of not sending performance report of Rai. So the grieved approach the General Administrative Tribunal. Pande’s motive was encoded in his remark that Rai had not kept his superiors informed that is why his performance report should not be forwarded for assessment and promotion. The high court was hearing the case on September 13, 2011. But secretly and in malfeasance the home department erased the remark. Chief Minister could not be blind to this goings on in his own home department where he was the senior minister and Amit Shah his deputy. Today Modi is in charge of the election campaign of the country for his BJP, Shah for UP and OP Mathur for Gujarat state. The year also saw election in Gujarat in which Modi justified the murder of Sohrabuddin and went to furthest extent by challenging Sonia Gandhi and the central government to arrest him. He even dared them to hang him! This did not sensitize the populace in Gujarat to the danger of outlawry of the chief minister whose parochial boast of his five cror people of the state lulled them to further complacence and sleep. Very few exceptional had their conscience in place. Among them was GL Singhal. He felt qualm over shooting innocent Ishrat Jahan and the others. His son committed suicide at age 17 and in his an agnorisis or realization and introspection he felt it was on account of his shooting the poor girl! The rest have hardly woken up even after it became clear that the IB special director Rajendra Kumar generated fake intelligence reports of ISI/ Lashkar-e-Toiba hand in the Godhra fire case of 2002, the Akshardham attack of September 2002, the Haren Pandya murder of 2003 and many other cases of outlawry going back to early 2001 of the fake encounter of Sadiq Jamal Mahtar. The brief interlude of an honest officer like Rai was repeated. In the case of the Chief Metropolitan Magistrate who obeyed the instructions from the higher echelon (euphemism from the office of the chief minister with his knowledge) and asked judicial magistrate Tamang to take up the case of Ishrat Jahan and three others and prepare a report immediately. Tamang did comply but honestly without knowing the evil intention of the higher echelon. They had to prevent the High Court ordering CBI inquiry into the case at the insistence of Ishrat Jahan’s bereaved mother. These brief interludes tell a different story of development in Gujarat of which the so called ‘vibrant Gujarat’ in its peak of adrenalin did not bother to notice. Still in 2007 Tehelka in its November issue showed how Modi changed judges who could give bail to Babu Bajrangi. A judge called Dholakia had told Bajrangi that the crimes he had committed at Naroda Patiya warrants several sentences of capital punishment and not just one. Modi changed him and kept changing judges until he got Tushar Mehat appointed to hear Babu Bajrangi case. Mehata did not even look into the files of the case but fortuitously gave him bail. That Mehta was present in the office of the home minister during the huddle of November 2011 as recorded by GL Singhal speaks volumes. The meeting was held to either sabotage the case of Ishrat fake encounter or cover up the guilty officers. There was a Gaurav yatra procession during which DG Vanzara had planted arms in the house of some Muslims that led to arrest and riots. Sreekumar was ADG of police in July 2002 when this happened. He claims: “had State Government taken notice of my report against Vanjara and taken action against him he would not have dared to indulge in the misadventure of staging fake encounter killings from October, 2002 to the time of his arrest in April, 2007.” 1 Surely it was Vanzara who had remarked that the grey beard and he black beard had known the murder of Ishrat Jahan and the other three. Vanzara was the right hand man of Modi very close to him about this Sreekumar writes: “Considering his extra-hierarchal accessibility to and rapport with senior leaders in the political bureaucracy in the State Government even his senior officers avoided reporting against him and had always turned a Nelson’s eye to his alleged misconduct and illegal deeds. So my act of sending a report [planting arms and causing riots] against Vanjara was deemed as “misconduct” by the State Government, though he was two ranks junior to me and Government restarted an enquiry against me.” Such an inquiry could not have been ordered without the approval of Modi and he was aware of what the staff close to him was doing. Hence his involvement in all these is legally legitimate matter for trial in a court of law or in a reference to the possible prosecution in future by the International Criminal Court in case Indian courts fail to punish him. It was the arrest of Vanzara in April 2007 that led to the disclosure of Ishrat Jahan case which had preceded that of Sohrabuddin case in the actual time of the murders. Had the government of Gujarat heeded the corrective measure Sreekumar suggested in his affidavits the SC would not have come down heavily on the state government of Modi. How could Modi pretend that he was not aware of the following as a consequence of his inapt government’s handling of cases including the two cases of Sohrabuddin and Ishrat Jahan: – 1) Transfer of trial of two cases to Maharashtra State. 2) Investigation of one mass rape case (Bilkis Bano case) by CBI 3) Re-investigation of 2000 odd cases closed by Gujarat Police 4) Entrusting investigation of nine major carnage cases to the Special Investigation Team (SIT) chaired by Dr. R.K. Raghavan, Former CBI Director. 5) Investigation of two fake encounter cases by CBI 6) Appointment of a Special Task Force (STF), headed by Justice Bedi to probe into 17 alleged fake encounters cases in Gujarat from October, 2002 to February 2007. Further action against Sreekumar must have also come from Modi when he was charged with bogus allegations and recommended for dismissal. His promotion was denied until he fought and got it, his pension was withheld for 18 months. There is no doubt of subversion of law and judiciary by the chief minister and ultimately as a logical inference of his own actions his complicity in such acts as planting of arms in the houses of Muslims of Kalupur and other places and having them arrested and also causing riots between two communities. Sreekumar had submitted four affidavits all regarding the genocide of 2002 another set of 5 in similar cases of outlawry. He was one of the senior most police officers therefore Modi cannot pretend not be aware of what he was doing. A comprehensive investigation by a neutral body of international level alone can deliver justice to the people who have suffered most. Each affidavit is enough to nail Modi’s coffin. No agency of the government can be absolutely completely working against Muslims or any other group. But the basic flaw is the penetration of the hate ideology of RSS which a chief minister like Modi and a high functionary like the joint director and later special director of IB Rajendra Kumar who subvert the Constitution of the country and espouse the hate ideology against the minorities and especially the Muslims. Sreekumar had worked as superintendent of police in 7 districts of Valsad, Amreli, Bhavnagar, Ahmedabad City, Mehsana, Kheda and Kutch. There was no wide spread disturbance including any riot between Hindus and Muslims during his posting there and hence the director of IB Mr HA Barari gave him a position on deputation in IB from 1987 to 2000. This contests with the thesis of Mushrif in his book Who Killed Hemant Karkare. A dimension of the basic flaw is after getting sworn in office of the chief minister Modi instead of upholding the Constitution and protecting all the citizens of the state he subverted the Constitution of the country in letter and spirit and punished honest officers who tried to hold the rule of law under the Constitution of Indian republic. In contrast is Sreekumar: “In January, 2001, I was deputed by the then Gujarat Chief Minister Shri Keshubhai Patel to supervise police work relating to relief and rescue operations, following a major earthquake on 26/01/2001 in Kutch district. Later the CM Shri Narendra Modi, inducted me in December, 2001 as a member in a committee headed by Shri R.C. Mehta, Former Special Director IB, to make proposals for revamping the State Intelligence Branch. So it is clear that I became a persona non grata to Modi Government only after I send reports against involvement of Government officials and Sangh Parivar supporters in the riots, being devoted to my oath of allegiance to the letter and spirit of the Constitution of India.” Till Modi, Amit Shah and OP Mathur going into a huddle as recently as oo2013 over the startling exposures in Ishrat Jahan case, Modi et al continued their suborning the police and subverting the Constitution. Even the kidnapping of Ishrat Jahan resembles the extraordinary rendition of Mohammed Bashmilah by the US in 2004. Bashmilah arrived in Jordan from Indonesia, he was taken away to Afghanistan and then to Poland and tortured. This South Yemen native was innocent and after many years at Guanamo Bay was released by the US. Modi’s Gujarat and by implication India proved more fatal than the US. The "covert prison system” that the US used was also emulated by Amit Shah in his own bungalow on the outskirts of Ahmadabad. No doubt the US secretary of state Condoleezza Rice termed this rendition as “vital tool” what Modi and Shah have done is discrimination against Muslims and trapping innocent Muslims for years and decades in prison and killing them wantonly as in the case of Ishrat Jahan. 3 Without having the power of the commander in chief Modi and Shah have used power to kill. When Senator John McCain introduced an amendment in use of extraordinary renditions as “cruel, inhuman and degrading treatment" of prisoners, President George Bush agreed but retained the power to apply it at will as commander in chief. Modi and others are itching for this for a long time to be their prerogative precisely for disposing off Muslims. Even the coming 2014 election is viewed as a referendum for presidency. Abu Gharib prison pictures appearing in media show the inhumanity of treatment of prisoners of war on terrorism. PM Vajpayee chose to piggy rode the US for the same as he remarked in Goa that Muslims did not know how to live with their neighbours. It was in that Goa enclave of his party that Modi was given a thumping mandate to carry on what he was doing. In June 2013 Goa meet his Hindu party enthusiastically elevated him for the same policy. This policy is highly discriminatory against the Muslims and considers Muslims only as terrorists and adheres to the belief that Hindus cannot be terrorists because it is not in their gene. IB officer Kumar was following this hideous policy because of the weltanschauung against Muslims in the aftermath of 9/11. Modi used different gateways to his adventures. He also threatened media people with the fate that meted to Washington Post reporter Daniel Pearl in a Pakistan. Openly and brazenly he contested elections on the premise that it was a fight between Mian Musharaff (the President of Pakistan) and him. The epithet Mian used by extremist Hindus is a derogatory term against Muslims as Bal Thackeray’s landya for the circumcised Muslims of India. All the fake encounter cases in Gujarat and Delhi and even Mumbai were passed off as Muslims out to create trouble or kill the Hindutva leaders like Modi, Advani and the fire eater Pravin Tagodia. The 17 cases in Gujarat alone will require many years to unravel the involvement of police killing Muslims for promotion and pelf of office. The victims have parents or siblings who could hardly earn their bread for the day let alone appear in courts during hearing sessions or pay the fees of lawyers. These atrocities never prick the conscience of the police or the pubic or the bureaucrats. In the case of Asimanand and GL Singhal it was personal tragedy, remorse or repentance. How great it would have been if the chief minister would have discovered them instead of hiding that would have made Narendra Modi a statesman rather than what I have called him in the title of my book Decade of the demagogue and his demagoguery.” He led the populace by appealing to their prejudices he shared with them against the minority Muslim community. As the chief executive of his state he is like the mayor in Henrik Ibsen’s play An enemy of the people. As a demagogue he is the true enemy of the people. He is like the mayor Peter Stockmann and not Dr Thomas Stockman who should have discovered that the source of revenue of the town, the hot water baths, were infected with germs. They were a threat to the life of the people. In hiding as did the mayor the mayor truly became the enemy of the people. Dr Stockmann tells his wife, “You will see he won’t like it’s having been I. and not he,that made the discovery.” Modi did not have Jashodaben in the family confabulation or else he would have learnt more rather than the hush up of celibacy that creates for the RSS pracharaks an aura of awe and respectability among the right wing Hindus. Ishrat Jahan, Bilquees Bano, Kauser Bi, and the woebegone anonymous women victims of pogroms could not have had the hand of compassion on their heads in the hour of despair and grief because of the conspiracy of Modi and Rajendra Kumar who made Godhra train fire an act of terror rather than accident. Many victims walked miles with iron rods and wooden sticks sticking into their middle part in their utter nakedness after being raped and survived they could not get a glass of water or a piece of saree to cover up the shame as they traversed Hindu areas to reach the nearest relief camps. In contrast Modi and his henchmen like Vanzara moved heaven and hell with impunity to cover up what their followers and men in uniform did to the Muslims. Such was the flagrant violation of the law and order they felt no need to hide and mistakenly believed all their works as ordained from above, not only from the higher echelon of the ruling party and bureaucracy but from god in heaven. In carrying out the murder of Ishrat and others the Additional Advocate General Indira Jaising there was drama that the police performed strutting on the stage. One such satrap of Modi was Purthuvi Pal Pande. "He is the mastermind behind the whole encounter. He was a conduit...he received inputs, passed it to his subordinates and arranged everything...in fact he was in total control of the operation. He actually acted as Rambo."1She also gave the logical and legal reason against Pandy: “A Division Bench of this High Court had in December 2011, upon reading the final report of the SIT, directed the registration of a fresh FIR in this case and ordered that CBI will be conducting investigation." Where is the reason to flaunt what Modi and his party is doing all the time that CBI is the handy maid of the Congress party? The fresh FIR is the inference one draws from the syllogism of how the drama was unfolding before the court and the public. Much before even this Pandey acted the same role in orchestrating the façade of Babu Bajrangi surrendering to the police after Modi persuaded him to do so. Modi was under the pressure of the Parliament criticizing the genocide and the role of Bajrangi. Lalu Prasad Yadav was vociferously focusing on the issue. There is no need to remind that Rajendra Kumar and Modi are both public servants and everyone is equal in the eye of the law. If it was policy of the state government to kill Muslims who, according to Vrinda Grover, stands to gain? It was Modi who gained most because it helped him win elections by objectifying Muslims as the ‘other’ and terrorists. And as Digvijay Singh also remarked that encounters raised Modi’s profile as an intrepid “hero”. Thus the carefully prepared fake in put that terrorists were on the way to kill Modi made headlines and affected the susceptible people of the state who not only identified with him vis-à-vis Muslims but also indirectly supported him for what happened in the genocide and subsequently in the fake encounters. 4 If the chief secretary of the government and the advocate general of Gujarat under Modi were involved in the fake encounters and the cover up it means Modi was directly involved in the fake encounters and the cover up. Therefore his definition of secularism as “Indian first” is the proverbial sophistry of the Hindutva when confronted with the problem of the minority Muslims. It amounts to if India is a secular state then it is because the Hindus are secular. But by this logic neither Modi nor the Hindutva groups get away for why did Modi pay two lakh for Hindus killed in the Godhra fire while Muslims got one lakh. So India first as secularism translated into practical terms amounts to denying Muslim justice. Either they live at the sufferance of the Hindu majority or leave the country or get killed. In the evening of the first day of the pogroms on February 28, 2002 Modi visited Naroda Patiya and told Babu Bajrangi that he had come to visit them to encourage them to do the killings and burning with the same zeal as they had done the first day! It was in this context of permanently changing the equation between Muslims and Hindus that Modi had in mind when during his visit to Udhav Thackeray he made the observation of his reactionary theory: "Democracy is not a contract between the ruled and the rulers, as political parties think. Democracy is an excellent system to correct the wrongs and to strengthen the administration"5 Modi’s Hindutva is of the never-feel-remorse/ repentance type and contrasts with what GL Singhal felt in the end: ‘Singhal is said to have decided to speak the truth after his only child, his 17-year-old son, committed suicide this year. “This is divine justice, sir,” he told CBI officers during a conversation, breaking down. “I have been punished as I killed the innocent.”’6 Another side of Hindutva is that if an officer is caught and there is no other way to save him then prevent other criminal cases slapped against him. This is seen in Malegaon cases, the ones accused in 2006 were also involved in 2008 blasts. The Hindutva way is that none of their activists should ever be accused of terror crimes because a Hindu is not a terrorist by his gene and faith. But if charges are brought against him prevent other charges being applied. In the case of Gujarat under Modi this has gone on in hundreds if not thousands cases. DG Vanzara et al were arrested in 2007 in the Sohrabuddin cases but none of them is charged in the case of Prajapati case though Tulsirm Prajapati was killed in fake encounter on December 28, 2005 by Vanzara and his assistants. Even in mid 2013 the situation is left to fester in the same way of wayward application of law and order and warped judicial process. Amit Shah as junior home minister is allowed to contest and win election and is now fighting election for the candidates of his party in UP though he is neck deep in crimes, including crimes against humanity. Kauser bi resisted her husband’s abduction by the police Shah told his cops to take her as well. They were brought to private farm houses one of which Shah owned along with Jirawala family. They were tortured and Kauser was raped. Tulsiram had known this and therefore he too was framed in false charges and brought from Rajasthan to court hearing in Gujarat and was killed. If this is not crime against humanity what else is this. Four Kashmiris were shot dead even though they had not committed any crime. They had come out their madrasa in Surat in March 2006. They too were accused of being on the way to kill Modi. The irrepressible truth behind the 17 or more such fake encounters, the murder of Haren Pandya, the genocide of Muslims and many such crimes is that Modi was himself directly involved in them. He was committed to Hindutva ideology which does not want Muslim to be in India. They should either go to Pakistan or be extinct. If Rajendra Kumar generated false input against Ishrat Jahan and did not intend that the police should rush to kill her and others, then it was the grey bearded Modi according to Vanzara who gave the order to kill them. If Ahsan Jafri made the last call to Modi and Modi cursed him that he was still alive it is logical to conclude that Jafri must wait for his fate in the hands of the encircling Hindu extremist baying for his blood. And true to his boss Vanzara wrote a poem from prison that the Muslims should be killed and along with their children and those who remain should be pushed into Pakistan. In the case of Tulsiram Prajapati Modi was personally involved for his own reason in addition to the Hindutva philosophy of hate. Haren Pandya was his bête noir and it was Prajapati who had killed him through his testicles. It was Pandya who had met the people’s tribunal making inquiry into the genocide of 2002 and told them how Modi had asked the police to let Hindus take revenge on Muslims for three days. Pandya had also made an audio record of the meeting. Pandya’s widow Jagruty went all the way to Vishakapatnam to meet the mastermind who spent 8 years in jail on the false charge of killing her husband. He told her the real truth of those behind the murder. She also believes that Rajndra Kumar had generated the intelligence input against her husband. If Modi stood to gain so much from the fake encounters he is also involved directly in the murder of Prajapati by having Vanzara transferred to Banaskantha. The Congress leader Arjun Modwadia told Tehelka:“What more evidence does the CID need? Not just Amit Shah, whose role is established in all the encounters in Gujarat, but even Narendra Modi should be arrested. Why was Vanzara transferred as DIG Border Range just days before the encounter takes place in that area? I would ask on behalf of the Gujarat Congress to hand over the Tulsi Prajapati encounter also to the CBI”. It will take much longer to unravel the full extent of involvement of the chief minister of Gujarat but one thing is clear Sadiq Jamal Mahtar , Ishrat Jahan etc. are clear murder cases different from the pogroms in the sense that the police are the killers in the fake encounters. Unless the principle of chain of command is fully explored and investigated and established justice would be delayed though not ultimately denied. Even so the killing of the victims on the pretext of threat to Modi is satiation of the thirst for blood that the Hindutva Moloch of modern times has evinced all the time. What he had told Bajrangi as his car stopped at Naroda Patiya that he was on round of visit to shore up their murderous instinct at the end of the first day, February 28, 2002. According to his stipulation there were two other days remaining to finish off Muslims! It was like the worship of the ancient deity the people worshiped, Moloch, who had penchant for children sacrificed at his altar. His worshippers would give child offering to him and to drown the wailing of the parents the priests and worshippers would beat drums loudly. Ishrat was a child almost at age 19 to her family. She was dragged out of the car and seven officers of police opened their guns to murder her. The presence of Kumar there was like the priests of ancient times propitiating the sacrifice. ------- 1. Until then the remaining parts of the charge sheet will be periodically released. By the time every charge sheet is in the hands of the lawyers the elections might be declared and certainly the cynosure of all attention on special director Rajendra Kumar would wane. Therefore the torments of hell will endure for the family of the four killed and anxiety would deepen in the seriously concerned. But the brazen politicians would have hectic schedule to play politics. Two most controversial points that immediately emerge will have to be thrashed to create a periscope to see what lies ahead. They have been raised by two sources: (1) “The CBI officers on this case believe that the IB generated a fake alert with the purpose to kill, but the question still remains what would the then station head of the IB, Rajinder Kumar, have gained out of the fake report and killing of Ishrat Jahan. If the IB Gujarat station head was directing that fake encounter or “murder” then what was the IB headquarters in New Delhi doing?” (2) "CBI is a central agency. So is IB. Why they (BJP) are defending the IB officer? What interest they have in protecting the IB officer? Why they are doing it? What is their intent,"1 The answer to these two is hidden in another question by another news source: “In any crime, the motive is the most important element to know to establish justice. The charge sheet is absolutely silent on the motive behind the crime. The question is why would policemen kill anyone or terrorists for personal motive?”3 The preliminary charge sheet and the briefing by CBI makes it public that the agency is going to deal with conspiracy and motive shortly to buttress its case. As far as conspiracy is concerned it goes back to the association of the RSS pracharak or group leader Narendra Modi’s staying together and close with the joint director of IB Rajendra Kumar in Chandigarh in the late nineties of the previous century. Modi was election in charge in Punjab. What was common between the two was their hate ideology of RSS of which both were adherents and this has not changed. They have never renounced their umbilical link to the mother organization of Hindu extremist nationalists. They show no repentance and never felt and will never feel why they should be apologetic. They owe their existence to mother India of the novel from which the song Vande Matrum comes, an India intolerant of Muslims. The other motive is money. The fake encounter of Sohrabuddin shows that money remains the most motivating factor for politicians and the communalists. Huge amounts of money was at stake not only for RK Marbles and its owner Patni or the association of the marble dealers, or the Rajasthan minister Gulab Chand Kataria but also for Amit Shah who had to handle a dozen ministries of the Modi government where money changing hands was the order of the day. Shah is involved in receiving bribes to the tune of thousands of crore. In killing a nondescript albeit innocent Ishrat Jahan from the worst slum area of Mumbai the wretched hovel of Mumbra, the officers, 7 till now charged, stood to gain enhancement in salary and promotion in office. Modi saw to it that they did get these what with their involvement in conducting the genocide of Muslims in 2002 and covering up the crimes against humanity thereafter and also managing the fake encounters from which he stood to gain popularity among the people and block votes at the time of election and not just one but three general elections! What more would BJP and RSS love to see or for that matter Kumar? What greater success can there be that you conduct genocide and fake encounters in broad view of the world and still get away with all this? That you have the impunity to threaten the media with the fate of Daniel Pearl and still the media cannot fully account for the innocent Muslims being framed in all kinds of terrorist acts on the premise that Hindus cannot be terrorists! 3 But why all the terrorists caught are then Muslims? So Muslims are terrorists until they are caught all the same! This is the topsy turvy world that the police and the Hindutva have belaboured to create as living hell on earth as far as the minority is concerned. It has gone through this for more than a decade and half. It explains why IB officer Kumar, a far senior in rank should go to the Crime Detection office at the Gaikwad Haveli or House in Ahmadabad and meet its in charge Vanzara and the deputy commissioner of police PP Pande on June 13, 2004 when Ishrat and others were in their captivity and also drugged. However, India is not a benighted country. Chapter 14 Hindutva’s new fatwa: Ishrat Jahan is “Lashkar-e-Toiba’s daughter and a ballot box” Countervailing politics of Sharad Pawar and Narendra Modi Even after Ishrat Jahan has been cleared of all charges that she was a terrorist the Hindutva groups do not view her as innocent. Shiv Sena is one of the most rabid of the configurations of the Hindu extremists and considers her as toiba chi betty, matanchi peyti “Daughter of Lashkar-e-Toiba, a ballet box.” (1) It confirms that the fight against terrorism in India is a political fight and there is no genuine desire to rid the land of the menace of terrorism. The tactical move of the extremists is to commit more and more acts of terrorism and blame it on innocent Muslims, rot them in prisons and raise the ire of the majority against the Muslims to gain votes to form Hindutva government. The chief minister of Gujarat Narendra Modi did it by his experiment in his Hindutva laboratory letting loose terror on the Muslims in the aftermath of the burning of the train compartment of the Sabarmati express. He blamed Sohrabuddin as a terrorist caught with cache of AK 47 rifles and told in an election rally that he d deserved it. His audience encored him for doing the right thing in killing Sohrabuddin. Even in the assassination of Haren Pandya eleven Muslims were arrested and after nine years the charges of terrorism were dropped against them. The eleven suffered hugely on account of the miscarriages of justice under Modi. According to this game plan of the Hindutva if the Muslim youths are radicalized and take arms against the state all the better for they would play in the hands of the Hindutva demagogues. Till then the fabricated charges of terrorism can wreak havoc on the Muslims. Those who have realized the implications of this game plan use the instances of framing of innocent Muslims to play countervailing politics. Sharad Pawa is the chief of Nationalist Congress Party and has held important posts as Chief Minister of Maharashtra, Defense Minister of India and now as Agriculture minister. He is an ally of the ruling Congress party. He has a remarkable tendency to seize the opportunity for his immediate advantage. It is in this context that he is raking up the issue of Ishrat Jahan fake encounter case as the general election 2014 is only few months away. But his observations go far beyond an election and for the Muslim community it involves an existential problem. 1. Pawar says: “An innocent girl (Ishrat Jahan) studying in college became a terrorist? Today all those officers who were involved (in that encounter) have had to go to jail. The court has monitored the case because of which the truth came out. But what about the family? The whole family might suffer if such injustice happens to their child and seeing this, if some person from some other family gets angry, then you can’t hold that person guilty.”(2) The strategic implication of the underlined is that truth would not have seen the light of the day had the Supreme Court not intervened through its observation. It appointed a Special Investigation Team in which the Gujarat government planted some dark sheep (better, Trojan horse) even then a member Satish Verma found out that Ishrat Jahan and three others were not terrorists but killed in fake encounter. He went further and hinted that the attacks in Malegaon 2006 and 2008 as well as Mumbai attacks known as 26/11 were also at the behest of Intellignce Bureau! What bearing has this disclosure on the destiny of Muslims in India if the chief minister of Gujarat ultimately becomes the Prime Minister of India? Can he assure the House of Commons in Britain that the future of India will rest on true democracy which truly takes into account the security of the minority (Michael Ignatieff, Blood and Belonging). What is the future of Muslims in India if fascists like Modi follow ethnic cleansing as advocated by the ideologue of RSS Golwalker whom Modi follows and is also a member and propagandist of RSS? Ignatieff’s subtitle of his book is Journey into the New Nationalism which Modi and Hindu party BJP chief Rajnathsingh call cultural nationalism. 2. It was Pawar’s suspicion of Abhinav Bharat involvement in the bomb blasts in Malegaon that led to the arrest of the AB activists’ arrest. “Three or four years ago in a speech , I had publicly told RR Patil that I couldn’t believe that on a Friday, Muslims would place a bomb in a masjid. I told him that the police’s line of investigation was wrong. Mr Patil then sent Hmant Karkare to meet me and I told him about my suspicions.” Pawar’s lieutenant and deputy chief minister as well as home minister Chagan Bhujbal and his successors were more interested in pillorying the ahele hadish group than fighting terrorism. In the case of the 2006 blasts leaders and ordinary natives had written to Patil minute details of what led to the explosions. The two worthies belonged to Pawar’s party. Twenty Hindus and a leading yarn merchant Mahesh Patodiya were detained but the Hindutva activists forced the police to abandon this line of investigation. Senior police officer Suryaprakash Gupta said a bullet cost 50 rupees and they do not want to waste government money when they would resort to firing. When within a month the police had questioned the Hindus why was Pawar sleeping until his birthday bash in Alibag on December 12, 2009 to air his suspicion? Even senior journalists Kuldip Nayyar and Ashish Nandy had realized that 2006 attack was by non Muslims! Can the survival of Muslims of India be a matter of how soon the ministers and journalists and writers realize the faulty line of investigation by the biased police? 3. “For three years, the 19 (sic) people from the Muslim community had to spend time in jail. How can they see this country as their country? If due to some treatment, he commits one mistake then should we tag the whole community as antinational? (AA) Muslims of India thank their lot of knowing Urdu for among other things it reminds them of their essence: khake watan ka mujhko har zarra deota hai. “Every speck of the land of my birth is a worshipful deity to me.”Even the ruing of Bahadur Shah Zaffar in Rangoon: do gaz zamin bhi na mili kooh-e-yar mein. The king carried a handful of soil from India which he wanted to put in his grave and said “he couldn’t get even two meters of land for his burial in his homeland of India.” Fast forward to the present, the neighbourhoods where Muslims are in sizable number like Malegaon in Maharashtra or Juhapur in Gujarat are habitually dubbed by the biased cops and others as mini Pakistan. And in this Muslim majority the people salute/owe loyalty to Pakistan flag. In such Malegaon how could Hindus dare enter and explode bombs is the thought that Mian Pawar could have but we don’t desire it. Colonel Purohit entered the Kashmir valley and risked his life for India. But it seems according to shariat court this brave officer has been put on the gallows.” 4. In the case of the innocent Muslims framed in terrorism in Malegaon and elsewhere, it "inflicted unprecedented agony on their families but also virtually eroded their sense of belonging to India"(3) As a matter of fact the Muslims have nowhere to turn to in the hour of their innocent youths being framed in false charges of terror; and they have not lost their balance of mind. They are not divisive but Shiv Sena and the rest of the Hindu extremists are in the mainland. Shiv Sena mouthpiece concludes: ‘pahlee beti dhana chi poti’ asa aamchakadhe manhle jaty pan “Toiba” chi beti hi sharadmiyan chi matanchi poti jhali aahe. Deshala ha motha khatra aahey. “First daughter is a treasure trove” is a saying among us. But ‘Toiba’s’ daughter is Sharad miyan’s ballot box. The country is in great danger on this account.” If Shiv Sena like the other extremist Hindu organizations is procrustean in its approach to Muslims and especially the innocent framed in terror charges the state of Gujarat is even worse. The Supreme Court had to hear a plea to continue to monitor the Ishrat Jahan fake encounter case among 22 such cases on Wednesday on August 14, 2013. The Chief Justice P Sivasatham allowed the monitoring group to include experts from outside Gujarat because of the vitiated atmosphere in the state against the Muslims. In what way this places Modi and his administration any higher than the Shiv Sena? Can the House of Commons discern the fuller implication of this development in their Modi led craze for material development on which he has challenged from Bhuj on Independence Day speech the PM Manmohan singh to debate? Modi’s basic tactic as a poll campaigner is to sweep the genocide and fake encounters under the carpet of development. How far the majority perceives the existential problem of Muslim minority in this contrast to gauge what exactly is the grave danger to the country they share with the Muslims? Another doughty politician rather a demagogue on the horizon is the Chief Minister of Gujarat who is also generating more frequency of tug of war on survival of the fittest level in the techtonic shift of cultures. Arriving in the surcharged atmosphere in Hyderabad (what with Togadia having called Akrabuddin as “a dog of Hyderabad” and Modi himself calling Muslims as “kutey ka bachcha”) Narendra Modi was greeted by slogans “yes we can, yes, we will do”, Modi responded “India is religion, the Constitution of India is the holy book, one crore and a quarter crore people’s interest, this is worship. With this resolves we will work for the welfare of the nation.”(Saamna) At around the same time his party’s “vision document” follows the Yankee rhythm of war on terror “why do they hate us?” by pointedly asking the minority Muslims “don’t vote for us, but don’t hate us?” (AA) Recent record shows illustrations of who hates whom and how much. Praveen Togadia: “On account of vote bank politics there is plunder in the country. Due to this a dog of Hyderabad has assumed himself to be a lion.” Modi has had always taunted Muslims as greasers and car repairers as eyesore on the highways and called the relief camps in the after math of the genocide in 2002 as the fast and exponential breeding ground of Muslims and a threat to the development of the state. His and his party’s spitefulness against Muslims is because they vote en mass to those parties like Congress and Samajwadi Party,etc who promise some positive or affirmative action to ameliorate their lot. Sachar Committee recommendations are an instance. Modi hates it and has refused to let the Muslims have whatever measly stipend or reservation in job is given to them. So it is clear who hates whom. Some Muslims with equanimity of mind expected that LK Advani would at least voice for the innocent arrested in Hyderabad Mecca mosque bombing. But he did not say a single syllable. On the contrary he wanted to change the course of the investigation against Pragyasingh Thakur and others in the 2008 Malegaon blast because of their adherence to Hindutva. He also brought unbearable pressure on Hemant Karakare against his neutral and objective way of investigation of the terror crimes. With this kind of situation do the BJP and Modi expect that the Muslims should dearly love the Hindutva band? Modi and Togadia have unambiguously called Muslims as dogs for different reasons which leave no ounce of either pity or love for the Muslims. Modi called Muslims kutte ka bachcha or puppies which were killed in 2002 and Togadia scorns the vote bank of Muslims that the Hindutva cannot afford to have because of their anti Muslim stand. In all these there is an imprint of a larger conspiracy that as President George Bush argued “either you are with us or against us” in war on terrorism and which the government of Vajpayee followed, the jamboree in the wake of meteoric rise in popular perception of Modi is following President Barack Obama’s election refrain “Yes we can, Yes we will.” (4)This latter misplaced enthusiasm has greatly eclipsed the crimes against humanity that Modi and his administration committed. They restrained the police from stopping the genocide in 2002 and then continued the murder of Muslims in the name of encounters that turned out to be fake. Thus the gaga of progress is a tactical move in the same direction as it is calculated to deflect attention from the pogroms. Even the dramatic disappearances and reappearance of the Additional Director General of Gujarat police PP Pandey accused in both the sets of crimes hardly dents the consciousness of the populace overwhelmed by the hectoring of Modi and his groups. This is also a ploy to attract western support to what is a national election matter in India thanks to the powerful Gujarati Diaspora. Its instant magic worked as the British invited Modi to lecture on the future of India that is made out to be more important than the crimes against humanity and the subversion of the judicial process that is still going on as Modi is touring for his election campaign around India eclipsing the goings on in the courts of Gujarat. Earlier in 2002 Modi invoked Mian Musharraf to fight the state assembly election. Due to this Pakistan’s President General Pervez Musharraf took the genocide in Gujarat to the UNO forum. These poll related issues are assuming larger dimension than ever even when Jawaharlal Nehru and Lal Bahadur Shashtri as prime ministers of India had a wider canvass of the non aligned nations and war with China and Pakistan. There is a sort of globalization of Modi. It is a fierce fight to stave off the bad publicity of the genocide because of which Modi was not given visa earlier or was unwelcome for state visit.
